Does the government work for us and we work for the government why do we have so much red ink -- the federal government tonight red ink and the constitution.
At the height of the debate over the take care of health care by the federal government last year a reporter asked and then speaker of the House of Representatives Nancy Pelosi.
If there was any limit on Congress's power to regulate human behavior.
After feigning shock that such a question should be put to her she answered quote essentially.
During the same -- during that same time period.
I asked congressman Jim -- and then the third ranking Democrat on the house where in the constitution is the congress authorized to manage health care.
And he replied that quote most of what we do is not authorized by the constitution.
And any added a judge can you tell me where health -- is prohibited.
To the congress in the constitution.
These attitudes about federal power are deeply troubling radically inconsistent with the constitution itself.
And essentially the principal reason why we have so much red -- and government today.
Pelosi was referring to the commerce clause of the constitution.
This is the clause to which the big government types in both parties point for authority to do almost anything they want to do.
The causes and the part of the constitution that lists the powers of congress and this -- states that congress can quote.
Regulate commerce among the several states and with the foreign nations close quote.
The framers who wrote the constitution gave this power to congress because at the time.
The states each imposed tariffs on out of state goods so for example the corn farmers in New Jersey.
Use their political influence with the New Jersey State Legislature.
-- persuaded to enact legislation imposing a tax on corn sold in New Jersey but grown another state.
That of course made the New Jersey corn cheaper in New Jersey and corn grown in other states too expensive to compete with the New Jersey court.
Of course other state legislatures responded and impose their own tariffs on all sorts of out of state goods.
The result was the use of political power by merchants.
To make it economically impractical.
For anyone from another state to compete with that.
And that severely limited the choices of businesses and consumers.
This was the state of affairs on the eve of the constitutional convention in 1787.
Thus the commerce clause was written.
To enable congress to prevent ruinous tariffs imposed by any state.
On out of state goods and so when the framers wrote that congress can regulate commerce among the states.
According to James Madison who wrote that phrase that congress can keep commerce regular.
Not control it.
Not regulate the daylights out of it but have the power to keep the states from destroying it.
The framers also know that a central government would have the tendency to usurp powers from the states and from the people.
Jefferson predicted this when he wrote that in the long march of history government grows and liberty shrinks and that's why we periodically have revolutions.
That's the framers wrote in the tenth amendment to the constitution that the powers not granted to the federal government in the constitution.
Are reserved to the states.
Fast forward to 1981.
And we would hear President Reagan remind us in his inaugural address of the historical truth that the states formed the federal government and not the other way around.
The premise of their formation of the federal government is that it would address only those issues and areas of human behavior.
Given to it in the constitution.
Raise the military keep commerce regular deal with foreign countries mint coin and establish their value operate a post office.
And the day to day business of government would be left in the states.
Now back to former speaker Pelosi and congressman -- Even though they took an oath to uphold the constitution that -- along with big government types in both major political parties have actually worked to subvert the constitution.
And that subversion has taken the form of writing any law they want.
Regulating any behavior they don't like and taxing anything that moves because they reject the constitutional restraints.
Imposed upon the congress in the constitution.
Their attitude has brought us the long litany of unconstitutional.
Laws and expenditures.
On declared wars TARP.
Corporate welfare stimulus packages entitlements like social security and Medicare theft of property.
Regulation of private harmless behavior while this has resulted in the government spending more money than it collects.
Two day in this regulatory state in which we live.
The Fed's collect about 2.4 trillion.
In taxes every year.
And they spend two point seven trillion in entitlements alone before they even get to their constitutional responsibilities.
Hence all the bar by the federal government.
And hence all the red -- What can we do about it we can return to first principles we can keep the government from bribing us -- our own money we can stop all the government borrowing.
And then we will have more freedom.
Tomorrow on freedom watch congressman Charlie Rangel on.
