Pat on the docket the Patriot Act this is the law that was put in place after 9/11 at the height of our terrorism -- And let's agents of the federal government write their own search warrants to your health bank computer and legal records tap your own phone tap your -- And basically spy on all Americans without the approval of a judge.

Anyone familiar with the Fourth Amendment knows that only judges can issue search warrants in America.

The Patriot Act is explicitly unconstitutional.

And it should be repealed or struck down.

But -- -- Americans let their lawmakers stripped us of our rights -- freedom loving economists predict -- I had put a wells saying.

Emergencies.

Have always been the pretext on which the safeguards of individual liberty have eroded.

-- 9/11 was exactly -- -- emergency that lawmakers used to create the Patriot Act.

Key provisions of this law are up for renewal in the house and the senate this week and our next guest is firmly opposed to them.

Here now Kentucky Republican senator Rand Paul senator Paul it's a pleasure as always welcome back to freedom watch.

-- to be -- judge what is happening with the Patriot Act in the senate as we speak I understand that you would propose some amendments to it.

Which would to safeguard the liberties that you swore an oath to uphold.

And the majority Democrats and even some of your Republican colleagues are giving -- hard to -- even allowing those amendments to be.

Debated and voted on on the floor.

Well I I think a stirred up a little bit of a hornet's nest yesterday I filibustered the Patriot Act.

Actually I defeated yesterday because they pulled it off the docket and they replaced it by amending a small business and administration bill in order.

For me not to be allowed to have any amendments.

Interesting thing is is back in February Harry Reid said I could have a week of debate and his many amendments in an open process is I want it.

But I kind of stirred things up because I first of all pointed out not only do they not believe in the Fourth Amendment that there's danger to the Second Amendment also have.

Once I brought the Second Amendment in -- connected to the Fourth Amendment.

I've got those who believe in the Second Amendment very interest in now on the Patriot Act and boy did this really -- Harry -- scared him so much he said no more debate.

No more amendments were getting this done by hook or crook we don't need any debate about the constitution in the senate well.

They don't want to debate the constitution in the -- as I understand it.

The extent what one of the extensions of the Patriot Act would permit federal agents without search warrants from judges.

To get information about who owns what handguns.

-- right that we all have by virtue of our humanity and a right guaranteed.

To be protected from the government from just this very thing.

By the second -- You want to prevent federal agents from getting those records without having to go to what judging get a search warrant first and that's what struck a raw nerve.

With some Republicans and some Democrats on the senate to I have that right.

Yes and here's the thing is it's it gets worse than that.

-- senate majority leader about thirty minutes came to the -- and attacked me.

And said that if my amendment passed that I would be allowing guns to get in the hands of terrorists.

And that I was in favor of terrorists having guns to attack America.

I was given five minutes to respond.

And I said if you believe that it's the same as saying because.

I think that a murderer alleged murderer we should have a judges -- before we go to their house that I'm somehow for for murderers that -- -- in favor of murder.

He's basically accused me of being in favor of allowing arms to -- to terrorists but all I'm asking is to Obey the constitution.

And I am respectful and a big believer that under the constitution.

We can capture bad people murderers rapists as well as terrorist.

But still keeping our individual freedom in the process yeah.

-- -- so many members of the congress each one of whom took the same -- that you did to uphold the constitution.

Is willing to run -- shot on the constitution.

In order to let federal agents do things that we fought a war against the British government and the revolutionary war.

Because British soldiers to do it we -- a Cold War against countries in Eastern Europe.

Because their governments -- there agents run roughshod over their people's rights without the intervention of judges like for heaven's sakes -- members of congress want -- permit our federal agents to do that to us and don't wanna even talk about it publicly.

I think some of its fear some of it's a misunderstanding.

Some of its that they think well gosh we've captured all these terrorists since we got the Patriot Act we wouldn't have gotten them.

But I'd say to those people.

You have to prove to -- somehow you wouldn't have gotten a warrant before the Patriot Act defiance of court never turn down any warrants for about fifteen years.

There's no indication that the -- as a court was gonna prevent warrants from happening when there were some evidence that terrorists was happening.

Where that terrorism was happening.

But the real anomaly here is that they defend the Second Amendment they wanna say they're for the constitution.

But the fourth -- really important and they just glossing over it but I tell people your second -- not say if you don't believe in the Fourth Amendment if you let the government go.

And sift through millions of records to see who owns guns.

This week they're gonna ask whether or not you donated to Republican candidate but maybe next year they're gonna ask -- -- own a -- or not.

And so I don't want the government sifting through those records I don't want the government to know anybody to know.

Whether there's a gun in my house or not because that unknown protects me and protects most Americans because the burglars in the criminals don't know.

Is there going to be a gun behind the door when they come in.

Switching gears I think you will shortly be asked I'm not sure -- it's tonight or tomorrow or later this week senator Paul.

The vote on certain budgetary proposals won by senator Pat Toomey won by yourself.

One by the house Republican leadership the one that was authored by.

Wisconsin Republican congressman Paul Ryan how are you voting on these proposals and what do you think will happen with the budget when it hits the floor of the senate.

-- no on Obama -- budget because it it spends 46 trillion dollars and now what adds eleven trillion to the debt.

-- no one Ryan because it spends 42 trillion dollars in -- six or seven trillion dollars to the debt.

Over ten years and doesn't balance for twenty some odd years.

I'm a possible yes on to me that I'm most excited obviously about the budget my office developed.

Our budget is the only one that balances in five years the balanced budget amendment and all 47 Republican senators have endorsed.

Requires balancing in five years in mine's the only budget they would actually do within the prescribed time.

They don't need to look seriously mind because I'm not sure how you can before balanced budget amendment that says it needs to be done in five years.

And not for a budget that actually does it in five year.

Is there any chance that a budget that actually stops additional borrowing will actually pass or are we doomed -- To even Republicans as well as Democrats voting to raise the debt -- President Obama and secretary Geithner borrowing more money.

And all of us going deeper and deeper into that bottomless pit of debt.

-- tell people they're they're not to be trusted with the money you gave them they're not accounting for -- they're not spending it wisely.

The Pentagon says they're too big to be audited they don't balance their books there was a hundred billion dollars last year and accounted for.

Don't give them many more money do not feed the animals in the zoo.

We do not -- to allow them to have more of our money we also don't have to default we bring in 200 billion dollars a month in revenue.

Let's just simply pay our bills out of revenue right we don't have enough for all the bills that means we would have to balance our budget.

I wanna hear you use that line on the floor of the senate don't feed the animals in the zoo senator -- it's a pleasure thanks for China again.
