Now to the lawsuit against the RS we've got 25 Tea Party and conservative groups who are pursuing their RS.
And top administration officials and joining us now is Jason -- -- -- Told the American Center for Law and Justice in the actually represented these groups -- welcome to the show up.
As they grabbed me and say what's that the -- what's the main point.
The of the losses.
Well -- story first we've got as you mentioned 45 plaintiffs in the case were about to increase that probably next week to another ten.
But of -- when he 510 still do not have their tax exempt status they've been pending for three years so it's obviously getting a tax exempt status for those individuals by the way that could have been handled administratively.
-- just doing a great -- -- -- for the questions that were relevant but the irises and complete lockdown right now so we got to get a court order to get those ten recognized.
Then there are some groups that actually lost grants where they were.
I had applied for a grant for educational purposes were awarded the grant celebrity getting there -- status did not get their -- -- status and time.
Or -- some of those not even yet one of the -- was 30000 dollars which a lot of people's not a lot of money to these smaller groups -- a lot of money.
Well and then of course some of these -- -- -- -- he's going through the process and we're gonna ask for an injunction.
So that the Irish practice topic Israeli -- does not stop its ongoing right now.
So I mean we always hear you can't -- -- city hall and certainly these targets are going after a lot bigger -- City Hall.
-- this is this something new is this something that's done regularly -- and how do you feel about actually winning this thing.
Well I've done you know I've argued over a dozen cases of the United States Supreme Court in some of those involve the federal government and we've won.
This is this is it's not the leader of the lawsuit if you -- it's an inch thick.
It's got a lot of allegations but you've got a very unique situation here where -- running against a government it's always a tough fight and will be a tough fight.
But the United States Department of the Treasury through the Internal Revenue Service admitted that they engaged in unlawful targeting that in of itself as a constitutional violation.
And violates the internal revenue codes meant Internal Revenue Service -- own manual so they've admitted liability in a sense which I think makes the case even easier.
Our -- gonna fight aggressively here because we're gonna get discovery which will include -- -- and a lot of other people are we're involved with the find out where -- really went.
Today we're talking right now about denial of tax exempt status for these groups what are you hearing about potential political audits or any political audits done.
Other groups or any group that you may know about.
Well that -- that's actually -- great question because out of nowhere about a week ago in the middle of all of this of one of our clients.
Received -- what's called a compliance audit.
And that is organizations that already have -- -- four exempt status.
That is that their tax exempt but now they're asked to fill out an eight page intrusive.
Question -- on line to the Internal Revenue Service.
While this mess of the IRS is going on so what -- you've got enforcement and exemptions doing one thing.
And that the compliance department doing something else so this is an ongoing problem and you know what's interesting here.
I used to work for office of chief counsel the IRS my first -- -- a long time ago.
I was the lawyer a trial lawyer for the IRS tax exempt with one of our clients.
But here's what's really happened here this was not decided by the but why would they call the line agents we know that's absolutely incorrect this went way up the chain.
But here's the concern.
The IRS -- -- questions never really focus on.
Questions that would be legitimate.
To a determination of exemption.
They went after this political as you mentioned political fishing expedition not just sit asking what issues you advocate.
But asking what side of the issue you -- what is your position on that issue.
And we know with -- street which is a conservative Jewish organization that took a policy position contrary.
-- the administration's on Israel and on the -- capital Jerusalem being Israel's capital.
Contrary to the Obama administration's position they were audited as well so wasn't just Tea Party groups the conservative organizations generally.
Today you may with a lot of parties on this -- the typical lawsuit does that make it harder.
In other words would be easier just -- sort of call -- -- Lerner and go after her individually or doesn't make it easier this way.
Well you have to cast a pretty broad net because this was not just.
Slowest learner and the there was the chance when we were drafting this lawsuit that would she would no longer be the -- of tax exempt which is now of course the case.
-- on administrative leave.
So we cast the net to those entities that were involved in the process that supports the Internal Revenue Service the department of treasury.
Be it when you -- the United States you you may named the attorney general not a permanent but it's like that service party so the United States -- -- these are all US agencies are dependent -- and that we have an unknown list of course -- got lowest -- holly pass these were individuals.
Inside the heiress but there's some -- we just don't know who they are very -- -- got to let Belichick okay what I did but before you do these groups also.
Real -- -- yes -- -- what they also like a formal apology for these actions as well.
Yeah -- like that formal apology actually be in the form of a a district court injunction because -- saying you're sorry.
Isn't good enough to be volatile fault or our love rock -- afterward the -- you don't get to say I'm sorry right back driving it really appreciated good luck but I think -- -- now.
