On fire or stuck in the -- That issue will most likely determine who gets voted into the White House come November.
But immigration remains an important issue for many voters my next guest is -- attorney representing ten federal agents in a lawsuit.
Against secretary of Homeland Security Janet -- -- -- And -- and customs enforcement director John Morton over president Obama's recent immigration policy switch.
Chris -- is in Kansas secretary of state.
Welcome to show Chris great to have you here so tell me.
What's wrong with the president's plan to allow young undocumented workers to stay in the country.
Well they're number of things wrong with -- one is that he did it through an administrative directive he basically had secretary and a part -- issue a directive in order.
Telling ice agents to stop following federal law.
There's actually -- federal statute that was passed in 1996 that tells these ice agents you must -- certain aliens and removal proceedings.
And that -- volatile directive says don't place them in proceedings let them stay.
And that's ordering agents to break federal law that's one problem with another is that they're circumventing congress in this White House that congress has considered the DREAM Act.
24 different versions of the bill in the last eleven years and is never passed congress clearly understands that if anyone's gonna pass an amnesty like this it has to be congress.
And the president's trying to usurp that legislative authority.
That those the two biggest problem.
-- you spend a lot of time thinking about this policy the president wants to put in place.
How well thought out is it as a practical matter what it work.
Well as a practical matter there are huge problems and we're already seeing it happening there the directive is already being used to tell.
These officers these ice agents let these people go.
And what's happening is the ice agents are being ordered by their superiors.
Don't even ask the illegal alien to prove that he qualifies so for example in El Paso.
There was recently a case where a a large young man 245 pounds assaulted and ice agent attempted to flee committed multiple felonies in the presence of the ice agents but then he asserted.
When he was taken and he said -- I qualify for the president's new DREAM Act in so many works.
And that the ice agents could even ask will prove it prove that your under the age of 31 prove that you came -- the United States a young age so basically it's again out of jail free card for anyone who's willing to just lie or tell the ice agents.
That they qualify it's it's really horribly implemented in practice already.
What you're sitting on the convention -- in -- -- -- -- this is a critical issue in the election currently if you look at the support.
For Obama among Latinos.
55%.
Support -- -- that Romney 20%.
If you push this issue during the election and do you think this is gonna rebound badly to the Republican candidate.
No I don't because I think there's a big myth out there that.
Latino voters are motivated by amnesty or not enforce -- immigration laws but you look at actual voting results like the vote on Arizona's prop 200 -- -- years ago.
Latino voters were split evenly pro and con on -- -- -- -- deny benefits to illegal aliens.
Are you look at polling data shows that on the issue -- illegal immigration a majority of Hispanic voters favor enforcing our laws more vigorously so.
While it is certainly true that there's a gap.
Right now in terms of -- Latino support for the two candidates.
I don't think you can attribute that gap to the immigration issue -- one thing we do know is that for all categories of voters jobs of the number one item this year.
And clearly I I believe Mitt Romney has much better plan for job.
-- Chris it quickly we don't have much time left the please tell me what the next step is in your suit he filed the suit what happens next.
Well next we'll go to some pretrial hearings in the judge will set the schedule for the -- it's in the northern district of Texas.
In federal district court.
And then we'll be asking for plenary injunction.
So that as soon as possible this unlawful order can be stopped by the courts -- Chris -- want to follow that story thanks for coming on tonight appreciate your time.
