According to a recent study the divorce rate among couples over fifty has doubled in the last twenty years.

What's behind the trend we get asked Vicky Ziegler divorce attorney extraordinary and author of the pre -- planner.

Okay it doubled in the last twenty years yes it's fun believe why -- people that are in their fifties and sixties are starting to say you know what I'm not happy.

You know you're raising your children you know -- focused on the children all this and they're gone they fly the -- to get married to go to college and -- -- and you're sitting there with -- -- going.

Why are we staying married it's not in our best interest because alike what is it about we wanna be happy nor -- relationship and an American if you're not he's have -- should have the right and freedom.

To me.

But I know firsthand it is.

It is not like he split assets 5050 it is not that simple it is very difficult we have a job market that's really tough.

-- housing market we can't sell your house and at what point people weren't getting divorced for that exact reason right oh absolutely and I think people are waiting for the economy have this little rebound people couldn't you know one -- -- become -- you can't get as much for your real estate obviously the market has been terrible.

But I think people are realizing I don't know how long that's gonna last so they're starting to say it's time you know what I'll take the emotional sacrifice.

And you know the personal freedom if I have some financial risk as you know that divorce is not easy I'm not saying that there's there's a panacea here.

But I think people are saying I'm willing to work two jobs to actually be happy -- have my personal freedom.

That's what people are really saying.

And you know people are also living longer all of a sudden we're gonna see a lot of people ninety plus walking around so why should people be in relationships that they're stocking.

You're right given the 4050 years to live you must will be happy I think interestingly 13 of all divorce filings contain the -- FaceBook of some sort what is socially doing -- it is turning the divorce world upside down I really every pleading I'd say one out of two pleadings has something to do with FaceBook.

Pre nup wise about the next time around you have fifty plus getting divorced odds -- that they didn't have a pre nup if they were married for a bunch of years right another starting over again.

Do you recommend they go into the next on with the pre nup unequivocally yes I mean there's really it's a small limited amount of time for people don't need a pre nuptial agreement if they really have no assets.

They don't have children but most of the time when you're getting married for the second and third time remember these baby boomers are really on -- second marriage some right and maybe even a -- it's important to segregate your assets make sure that any inheritance is any businesses that to have.

Anything intertwined with your family is gonna be protected in the event of divorce it's not romantic but it's necessary.
