But here.

Did not the United States historic day at Washington yesterday as we've been talking about you had the two.

Big stories of course the attorney general Eric Holder the first sitting cabinet member to be held in contempt of congress and then the historic ruling.

On health care here to talk about it all from -- Fox News is Juan Williams who's so with us here in New York in the studio -- could see 1 good morning.

The holder deal obviously they wanted to turn over these documents for -- I think most people know this fast and furious story by now.

But you think it's just teach you are pure politics.

Colorado wanna tell -- in my age but I'm old enough to have been in Washington 35 years watching politics watching congress -- and I've never seen such.

-- -- angry bitter politics being played -- just there's no purpose to it at this point the administration.

Offered to show them.

The papers that had nothing to do with the passengers operation would have to do with the political response to it -- and shared this with instead you know what we'll share with you can read it.

We just don't wanna turn over to you as a matter of principle that a lot of -- -- public apparent correct.

OK fed now they said no we're still gonna have this content what now what is the point of -- that's always that the bottom line because here's your point is that they could get the information they -- they -- information is -- her -- it has nothing to do with the operation nothing to do with the death of the agent nothing -- -- -- -- cover -- And no apparently there is no car the only cover up is that the -- about Obama administration doesn't want its profanity or any kind of you know we're trying to.

Not Stonewall this or don't do that they don't want all that kind of deliberative communication.

To come out and then expose them to some scorn but that's.

It -- if you had to guess you would say this is just embarrassing you in it's it's kind of stuff.

-- off the record type emails -- the language Iraq formal people say hey we don't want this to get out that way and.

Exactly inside politics it's not even -- our strategy it's it's as if you were talking to a public relations -- -- you're talking to a lawyer at the White House is talking to a lawyer or an official at the Justice Department.

But my point to -- is and the reason I think this is such.

A vindictive -- is there's no product at the end of the content it's not as if now additional papers are gonna come out in additional information but it and -- back so it's just an empty.

Act if it's no big deal at all I understand the embarrassment factor -- when the just release attendant just get this over with the move on and say hey.

Yeah that's the way you know because that story would die after a little while wouldn't just like Romney's campaign -- kind of basically admitting the way presidential politics are run.

Saying hey we're gonna -- didn't say that -- does have basically say we're gonna move to the center of the general.

Election and it -- oh my god that's if we were so surprised right if it's something like that why would they just release should get a couple days out of it and goes why why -- being so.

It just standing up to -- to the point where the attorney general's held in contempt.

Because.

-- to the chairman of the house oversight committee and the Republicans.

Had made this into a major fight and tried to embarrass holder and tried to belittle holder and then.

The president and the White House have now decided to stand up for you agree with that you -- -- but here's the point I really agree and you can say when we're in other should -- stood up for holder or not you know.

-- -- -- can just get this over with as you rightly saying.

But here's the thing.

Attorney generals going back to the Reagan administration said we are not going to give congress are deliberative communication and -- shortly out.

It when there is a possibility of prosecution.

You cannot release documents that would have to be entered into court to the congress without those documents then being ruled invalid for prosecution.

OK fair enough then that kind of transitions -- to health Carol because you talk about the precedent setting nature of something.

Joseph reaction this morning what are you thinking about this morning he woke up and you sit and you thought about yesterday's ruling which basically upheld the the president's health care law.

There's good news you know that the good thing about it is from my position you think about the politics.

And the personalities involved and obviously.

The right in this country's in a fury over chief Justice Roberts feels as if he betrayed them and it's a man who was appointed by the Bush Administration -- like -- -- Citi.

Re wrote we -- summit as early as that he quote quote re wrote the law and -- pocket and so here with the betting before the game began up.

The betting was either six -- three with Roberts and Kennedy going with the liberals or five the floor with Kennedy sticking.

With eight.

Our conservative majority including chief Justice Roberts instead Robert shifts over what the liberals yes.

And Kennedy writes the -- the -- what do you make of that -- -- that was you're right it was it was an aggressive.

It was I mean you couldn't be more clear Anthony Kennedy and -- in saying how much.

He -- that the set was this is wrong.

Basically totally wrong totally wrong and what he said was here's the federal Supreme Court.

Putting a tax on the American people.

And basically saying the Chief Justice Robert was playing a game of twister -- almost got his joints out you know pop joint in his life in order to make the argument.

Oh we had this -- the tax and therefore it's legal and let me add then from the left side.

From people who finally got chief Justice Roberts and bring them.

You get.

Justice Ginsburg saying you're wrong chief Justice Roberts this is -- legal under the commerce clause so the politics inside the Supreme Court.

Are passing a -- that is in my my account.

Very quickly that it was the credibility of the court and the legacy of Roberts as Chief Justice that was his primary concern.

It seem like.

Thank you want rebel basically at a time here but the president be criticized.

-- for not getting the message out there right the first time and if you have a chance to do it again.

But at the same time he better be careful not to let this be painted as the biggest tax increase if it is that an American history that's the Republicans are saying and that -- have.

Might gonna say it would happen with the Romney plan that was that was the same deal and it's a disincentive.

And -- you know politicians can't use them they've been on the Imus show they don't talk streets and really.

Truly I'd really have you want straight ties with what's britney's father that but you're right if you wanna say hypocrisy on the tax thing upon receipt of what most Americans that -- they look.

Let's move aren't enough how many times are gonna fight this thing back up and talk about how politics they're gonna have another vote on this going nowhere.

Good to see one yet they'll vote to repeal it -- house which is largely.

Ceremonial -- -- thank you very much you -- generally have a.
