If the Supreme Court strikes down the president's controversy -- health care a lot tomorrow.

The majority of Americans agreed they want congress and the president to start work on the new -- a plan B.

But what is planned -- -- -- do they even have one and how would anything get done with all the partisan gridlock on Capitol Hill.

Let's ask congressman -- -- from Texas the chairman of the House Republican Conference.

Congressman it's great to have you on the show thanks for coming and I wanna start with this idea what John Boehner said this morning speaker the house.

Saying it for the camera -- -- the individual man to get struck down we're gonna try to repeal all of the bill -- I was right.

Next to him when it said it dollars cheering your moment.

I mean the truth of the matter is it remains a bill that's impeding our economy.

You talk to any business in America -- the recent chamber of commerce.

Poll of small business people three quarters of me tell you it's inhibiting job growth the Congressional Budget Office which by the way you've won by Democrat.

Says it cost us almost a million jobs you talk to any employer.

Those in medical devices.

Small businesses who don't we don't think it's a nightmare number one in the second of all the ways -- an almost two trillion dollars.

800 billion.

New taxes well -- you can't -- awarded the numbers are.

Spectacularly.

-- Affordable Care Act is not a she's not affordable and the questions of course about -- -- actually improves care.

And lowers the cost for individuals in the answers to both of those possibly now we're still waiting to see tomorrow morning.

I would ask you go.

If this court court does strike down individual mandate as John Boehner said.

Is it possible that we've got a bigger problem than we did before because there is no funding mechanism now for the.

As.

Well you know all the Democrats told us without it the bill -- -- And I I agree with.

But in the short term I'm not sure the president's going to admit to that.

We Americans are still we still have challenges in health care.

But house Republicans are not gonna repeat the mistakes of the Democrats and be some kind of bums rush.

Rush through -- complicated complex 2900 page bill that no one understands.

Takes -- steps common sense steps incremental steps.

Make sure that health -- more affordable and portable in maintains its high quality and access to.

-- point Americans have said they want another bill that this one does go by the wayside.

They want new legislation.

The work at the issues that -- really care about which is the escalating price of health care and also the quality of care what Republicans prepared to do.

To see those things come to pass what elements of the above GOP led bill with their very.

Well again the first -- -- to do is listen to the American people which is.

Not committing the same mistakes that the Democrats did before that I think there -- number of common sense Republican bills that are out -- number one we can work on medical liability reform.

There's something fundamentally reform is that gonna go to the pockets of the -- absolutely positively unequivocally because we have defensive medicine it's getting practice all over this nation.

Ask any doctor I bet you an average.

We're somewhere in the neighborhood of twenty to 30% of the medicine which is practices totally defensive medicine gat -- medical liability -- We had in my home state of Texas and improved our quality improved our access.

It helped bring down the cost that would just -- -- issues item we.

There are issues that Americans -- that are important to -- and I wonder how you feel about it.

Preexisting conditions they -- to be able to get coverage if they have preexisting conditions.

And they want their kids to be able to get on their on their plan if there ups the H two point six those are two things they love out of Obama -- I'm not sure how Republicans feel about those two issues what -- well right you know.

The insurance company said by and large said the major ones are gonna continue -- with the 26 year old -- region -- -- legislation.

That we've had in the past we -- -- 25 the preexisting conditions are important but right now there is a very important issue.

-- but the federal.

A risk pool that was set up -- the president's health care we have right now -- 60000 people at 300 million.

It's important that Americans know that one debilitating disease won't wiped out a lifetime savings.

But that -- really talking about it that does it mean that we need the president's government takeover of health care.

To address this problem and so will help.

-- and pick up about one more question please hurry up and it's the question something that your opposite number at on the democratic side had to say this afternoon.

Congressman hobby -- -- Sarah had this to say about Obama care tomorrow's decision.

Probably the worst -- we can see it's a fight court decision.

Because.

I think that will -- And -- a long way in confirming.

This growing belief in the god of the American people of that.

The Supreme Court no longer care so much about the constitution he cares more about politics.

So congressman essentially he was saying that he's worried that that -- will be so close that the American people will think that that justices were just voting their political agenda what do you say to that.

Well he's obviously reading a different constitution that I am.

It's a co equal branch contrary to have the president got it -- since -- very vs Madison.

They have the opportunity to review this.

We have an interstate commerce clause.

We have an enumerated powers clause if you have a government that can -- They can essentially regulate inactivity what's next -- of the finest and we don't eat broccoli -- Tuesdays at.

I think again another discussion are they gonna force us to join health clubs and -- the more interesting question is besides the policy this is -- the constitution.

If so -- we -- an overreach is it about the power of the federal government how far it's about.

I believe sincerely as do lots of people all across America.

That besides being bad policy this is overreach it is unconstitutional.

Law to seriously -- an American in the privacy of their own home to -- him.

Get off your Duff -- buying insurance policy or we're gonna find it's wrong it's unconstitutional.

We can better.

And on that note congressman actually paycheck I got and I was a pleasure talking to Bernanke's.
