Now has its own union guessing union made up of only employees in the stores get this women's shoe department.

Georgia Republican senator Johnny Isaacson is blast in NLRB say the labor board has run -- he joins me now from Washington and a Fox Business exclusive.

I don't know why are you so upset by the fact that this is a smalley union that is being formed.

With -- frankly a smaller size department store in the nation why isn't -- -- Problem for.

Well first of all for eighty years we've had -- law in the United States of America labor law but the NLRB National Labor Relations Board.

And decision call specially health -- decide they micro unit.

Within the macro facility -- -- themselves think about this for second and Bergdorf -- a good example.

You could go on a department store organize every different apartment with a different -- you can have.

Forty or fifty -- you have no more cross training -- another negotiating with there's no representation fairness it is a -- it is regulation run -- Okay senator we talk to the NLRB and they told us.

That that there are no examples of vote warning unions in the company email also said look this was the New York court's decision.

And there were just rolling on an existing loss -- nothing here is is being done -- obviously not an agreement that.

No I don't agree with that that's -- we've introduced representation fairness restoration act to return the law.

What it's been for -- years so that then RB can't re interpret the law and apply different.

Let me ask you this agreed if you look at the amount do you think that the board itself but because it's it's a small amount 46 employees were talking about a -- The women's shoe department only not to mention department do you think that that -- and I'll -- overall is actually using this as a side.

Side ruling to try to get more union representation in companies or do you think that they were just basically going on the lot because that is a possibility -- enough that they told.

Well based on all the other rulings that they have -- like quickie elections and things of that nature.

They've tried to tip the playing field or hard on level the playing field between management.

And labor in this is just another example there's a technical term for what they've authorized hear its call -- Where you put one small unit within a company that's not unionize and then use those workers trying to expand the union.

That's always been unfair and it's always not been allowed and labor law and it shouldn't be allowed.

Senator Isaacson Bergdorf Goodman themselves have not relate come out swinging against us the company themselves.

Why do you think that is.

Well I know the national retail association and most all organizations that have multiple departments within their facility.

Whether it's manufacturing or whether it's retail sales are all super concerned about this ruling because it runs the risk.

Of causing MA -- major labor management battle in all kinds of its old.

Senator Isaacson we -- certainly going to be following this story here Fox Business thank you for speaking with us explicitly about the us thank.
