Easel as of right now Supreme Court justice Anthony Kennedy question the constitutionality of obamacare -- individual mandate so up.
If that mandates all the entire law is struck down what happens to -- -- health caste system.
Will it be sure it's even worse that it is now.
Republican congressman and a medical Dr.
-- -- -- Republican from Georgia is on Capitol Hill and he joins us now.
-- -- You're not done.
But -- I think we've got pretty much chaos and health -- and now I'd say it gets a whole lot was if Obama -- struck down.
Well Stuart.
You're absolutely right unless the whole law is struck down you know in regard to this ever built the -- issue they -- on Monday.
On the you know 17%.
Of Democrats think the whole wall should be struck down.
And 31% of Democrats think the individual mandate should be strong.
All that was reported in the Washington Post ABC -- and gets to that -- to college you wanted to replace it with.
At this moment we if you struck down -- got nothing and then to put in his place and as you know if you did you couldn't get it passed -- -- fall way into next year.
Well your original question what was what would happen if the individual mandate was struck down in the rest of the law was allowed to stand.
Well direct jobs and the health insurance industry you're talking about 2.3 million.
According to Bureau of Labor Statistics.
In all what you all kind of jobs across the country when people not hiring because of -- The vote the penalty that I have to pay if they didn't provide health insurance.
The cost of that would have to -- -- they had to provide government.
-- all of mandated health insurance so yeah I mean it would be a disaster.
Because that provision that -- as.
Community rating -- for people with preexisting conditions the adverse selection would occur.
Health insurance premium for everybody else would skyrocket probably go -- 40%.
So it would be an absolute tsunami.
-- -- if if that should happen.
So what is is there a plan in place and if you do have a plan in place to do -- about this -- you have any hope of passing it before next year.
Well look.
Pres Obama auction -- Senator Obama had it right before President Obama got it wrong in regard to the individual mandate.
If he's reelected to then maybe we can convince him of the congress can convince him that this is this law is so as a -- wall.
And that we need to to to repeal it and start over again.
And do what we suggested in the -- on the Republican side -- -- you have this those state assisted federal government assisted.
High risk -- within the states.
But you allow individuals to purchase health insurance across state lines.
If you treat people equally well equally in regard to the tax code or whether they get the health insurance -- -- -- -- back from an exchange your independent health insurance market.
Intercourse medical -- funeral which we just laugh -- -- -- Strike down I have.
There are a number of things that we can and will do.
All he -- -- postponement.
If they have so fact you know whatever the -- is in regard to congress -- the supreme striking down the individual mandate.
That the political thinking today is that Democrats are.
I you know hope secretly hoping for this legislation be struck down because then they can sort of back away permitted say we tried it.
You know the court is biased and they struck it down we did the best we could and they can sort of distanced themselves from the legislation and still have a rallying point do you buy that theory at all.
I don't buy that theory but I think you're right in when you when you hear the comments now from.
Although the liberal bloggers are saying well you know the individual mandate was never really that important in and the rest lawless so good that it can stand -- it.
That he is a bunch of baloney is.
My good friend former speaker Newt Gingrich might -- No I don't -- -- dog but one bit but they're beginning already as you point -- put that spin on in anticipation.
The it if sometime in June that those the supremes.
Well indeed agree that individual mandate and maybe the Medicaid expansion as well off are both -- constitutional.
-- -- -- the Gingrich a Republican from Georgia thanks very much for joining.
