Presenting the family of Euro us Border Patrol agent Brian Terry gunned down by members of a Mexican drug cartel.

Is now considering a lawsuit against the federal government.

To AK 47 rifles -- operation fast and furious were found next to the body of agent Brian -- The killings sparked the ongoing investigation into the botched gun running program carried out of the Justice Department and the Bureau of Alcohol, Tobacco, and Firearms.

Terry family attorney Paul Charlton joins us now from Phoenix Arizona Paul thanks for being here.

Internet and is has anybody from the Justice Department as the head of the ATF.

Have they reached out to the Terry -- -- No one has come forward to the Terry -- -- and accepted responsibility.

But it's failed investigation for this tragedy that the family is now living through.

That's incredible.

I'm Donahue I'm in -- at least a human what one would have expected.

That it would be otherwise what you're -- said that.

And that that Terry clearly doesn't want to see individual prosecutions here Paul but they do obviously want to understand what happened.

Where do you go from here.

-- We want to see greater transparency in this investigation this is not an investigation that can take place with redacted documents and reluctant witnesses.

The Terry family deserves to know exactly how it is a federal investigation.

Led to killers receiving firearms that are now responsible for Brian's death.

This investigation is moving too slowly and it really should be a simple matter of discovering.

How -- is this investigation was approved despite that many many different warnings that ought not to ever ever gone forward.

Now when you say the investigation or your term about the investigation by action led by congressman -- our allies to the chairman of the house oversight committee.

Who by the way is now has demanded production by the Justice Department.

Of communications of twelve top members.

The Justice Department's management.

Or are you referring to the inspector general's investigation.

-- -- Talking about I'm talking about right now it congressman -- is investigation accomplish its investigation into.

What went wrong here were hoping that the inspector general report occurs quickly and then we can learn what happened there and we -- of course are doing our own investigation as well.

And Kenneth -- the handover the acting hands of a ATF.

Wanted to testify.

Before before the crisis committee.

To talk with his investigator.

About was told by justice he -- directly.

Was told that he could not your thoughts.

Well I what I can tell you is that instead of accepting responsibility.

For what happened in his agency.

What we're hearing is that.

The director pointed the finger at his subordinates for not keeping him -- pointed his finger at the FBI.

For not keeping ATF informed.

We're seeing other agencies pointed fingers at other agencies.

This family deserves to have someone with enough -- enough backbone to stand up and say I approved fast and furious it was wrong.

And it should never happened that needs to happen first because until we get people.

-- enough courage to admit that this was wrong it's going to continue to happen again and again and some other families somewhere in blue is gonna live through this same tragedy.

Are you prepared is.

Is Brian Terry's family prepared -- through the through those that your -- responsible in the federal government.

Military families asked us to look at the facts in the law and to make a decision about whether or not they should go forward with a lawsuit.

And it may be that that's the only vehicle that they have to make sure that these tragic events don't replicate themselves because as of right now.

We're not seeing enough acceptance of responsibility we're not seeing enough.

Of an understanding within the Department of Justice -- ATF that what happened here was clearly wrong.

Paul -- thank you very much for being with us -- -- Paul -- represented.

The family of murdered.

On US Border Patrol agent Brian Terry.
